Welcome to SurveyToolkit, a product of Axis AI LLC ("Axis," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the SurveyToolkit website, application, and related services (together, the "Service"). By creating an account, activating a license key, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is
SurveyToolkit is a software tool that locates, retrieves, and parses information from publicly available online land records and county Geographic Information System (GIS) services, and presents computer-generated outputs such as plotted boundaries, closure reports, area calculations, adjoining-parcel maps, identified easements or exceptions, and exported CAD files. The Service is provided for informational and productivity purposes only.
2. Not a substitute for professional services
SurveyToolkit does not perform land surveying, and it does not provide legal, title, engineering, or other professional services. It is a tool that assists professionals; it is not a substitute for a boundary survey performed by a licensed professional land surveyor, for a title search or opinion, or for professional legal advice. Using the Service does not create any professional-client relationship. Any decision, certification, plat, map, or document that relies on the Service remains the sole professional responsibility of the licensed professional who signs or stamps it. You agree to follow all applicable professional standards, laws, and regulations in your jurisdiction.
3. Accuracy and verification (please read carefully)
The data the Service uses comes from third-party public records and county GIS sources that we do not control and that may be incomplete, outdated, inaccurate, or unavailable. Outputs produced by the Service are automated estimates generated by software, including optical character recognition and text parsing that can misread documents, especially older, scanned, or handwritten deeds. You are solely responsible for independently verifying all information against the official recorded documents and a field survey before relying on it for any purpose. You acknowledge that boundaries, areas, closures, easements, and exceptions shown by the Service must be confirmed by a qualified professional.
4. License to use the Service
Subject to these Terms and your payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business or professional use. You may not resell, sublicense, share your license key, scrape, copy, decompile, reverse engineer, or attempt to access the underlying source code, or use the Service to build a competing product. License keys are issued to a single customer and may be revoked for violation of these Terms.
5. Accounts, keys, and payment
You are responsible for keeping your license key and account credentials confidential and for all activity under them. Paid plans are billed as described at checkout. Fees are non-refundable except where required by law. We may change pricing on a going-forward basis with notice.
6. Acceptable use
You agree not to use the Service unlawfully, to violate any third-party terms (including county or records-provider terms of use), to overload or interfere with the Service, or to misrepresent its outputs as a certified survey or official record.
7. Intellectual property
The Service, including all software, text, design, and the SurveyToolkit and Axis AI names and logos, is owned by Axis AI, LLC and protected by law. These Terms grant you no ownership rights. Public records retrieved through the Service remain subject to their sources' terms.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ITS OUTPUTS WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, OR ERROR-FREE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXIS AI LLC, ITS OWNERS, MEMBERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROFESSIONAL LIABILITY, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ITS OUTPUTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
10. Indemnification
You agree to defend, indemnify, and hold harmless Axis AI LLC and its owners, members, and partners from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your reliance on its outputs, your professional work product, or your violation of these Terms or applicable law.
11. Termination
We may suspend or terminate your access at any time for violation of these Terms. You may stop using the Service at any time.
12. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws rules.
13. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
